Spouse Reports Affiliate Agreement

This Agreement governs participation in the Spouse Reports Affiliate Program, operated by Build Our Kingdom Publishing LLC ("Spouse Reports", "we", "us"). By applying to or participating in the Program you ("Affiliate", "you") agree to these terms.

1. Participation

Participation is free. Applying does not guarantee acceptance. We may accept, decline, suspend or terminate any application or account at our discretion, in accordance with this Agreement.

2. Relationship of the parties

Your participation does not create employment, partnership, joint venture, agency, franchise, or ownership rights of any kind. You are an independent participant. You may not describe yourself as an employee, owner, officer, spokesperson, counselor, therapist, or representative of Spouse Reports unless we authorize it separately in writing.

3. How you may promote Spouse Reports

You agree that you will:

• Represent Spouse Reports accurately and honestly.
• Use only approved marketing materials, or your own materials that comply with this Agreement.
• Disclose your affiliate relationship clearly wherever required by applicable law, including advertizing and endorsement rules and the platform rules of any social network you use.

You agree that you will not:

• Make false, misleading, exaggerated or unsubstantiated claims about Spouse Reports.
• Promise or imply any relationship, marital, emotional or therapeutic outcome or guarantee.
• Present Spouse Reports as therapy, counseling, medical care, or a substitute for professional help.
• Use deceptive, manipulative or misleading advertizing of any kind.
• Send spam or unsolicited bulk messages by any channel.
• Engage in illegal, deceptive or unethical marketing.
• Bid on, register or use domains, handles, profiles or account names designed to impersonate Spouse Reports or imply official status.
• Impersonate Spouse Reports or any of its people.
• Manipulate, circumvent or interfere with referral tracking.
• Generate self-referred, fraudulent, incentivised or artificial transactions in order to obtain commissions.

4. Commissions

Commission is earned on eligible payments that are successfully collected and attributed to you, at the commission rate applicable to your account at the time the payment is collected.

• The commission rate used is recorded on each commission at the time it is earned. A later change to your rate does not alter commissions already earned.
• Commissions are held for a period set by Spouse Reports before becoming available for payout.
• Recurring commissions continue only while the referred customer's subscription continues to be paid.
• We may change the default commission rate, holding period, payout threshold and program rules prospectively.

5. Referral attribution

Attribution is recorded when a referred person creates a Spouse Reports account, and is stored against that account. Spouse Reports determines attribution, and its records are the authoritative record. Only one affiliate is credited for any given subscription. You may not alter your own attribution or that of any account.

6. Refunds, chargebacks and reversals

If a payment is refunded, charged back, reversed, or determined to be fraudulent, the related commission may be reversed. If it has already been paid to you, we may deduct the amount from future earnings or otherwise recover it where legally and contractually permitted.

7. Payouts and taxes

Payouts are made once your available balance reaches the minimum threshold, on the schedule we operate. You are responsible for providing accurate payment details and for all taxes arising from amounts you receive. You may be required to supply tax documentation before payment.

8. Customers remain our customers

Referred users and couples are customers of Spouse Reports. You obtain no ownership of, right to, or interest in any customer account, customer data, or relationship data. You will never receive access to customers' private report answers, grades, relationship information or personal content.

9. Intellectual property

We grant you a limited, revocable, non-exclusive, non-transferable license to use approved Spouse Reports names, logos and marketing materials solely to promote Spouse Reports under this Agreement. All intellectual property remains ours. The license ends when your participation ends.

10. Investigation, suspension and termination

We may investigate affiliate activity at any time. We may suspend or terminate your participation immediately, with or without notice, for violation of this Agreement, fraud, abuse, misleading advertizing, reputational harm, or other conduct that we reasonably believe threatens Spouse Reports, its customers or the Program.

On suspension, commission-generating activity stops in accordance with Program rules. On termination, your affiliate access and earning eligibility end.

We reserve our rights in respect of unpaid commissions, future commissions, affiliate links and referral attribution following suspension or termination, subject to applicable law and the terms in effect. Historical records are retained for accounting, audit and dispute resolution.

11. Changes to the Program and this Agreement

We may update this Agreement and the Program. Updated versions are published with a version number and effective date. Continued participation after an update constitutes acceptance of the updated terms.

12. Disclaimer and limitation of liability

The Program is provided as is. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or anticipated commissions.

13. Governing law

This Agreement is governed by the laws applicable to Build Our Kingdom Publishing LLC's place of formation, without regard to conflict of law principles.

14. Entire agreement

This Agreement is the entire agreement between the parties regarding the Program and supersedes prior discussions relating to it.
